JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 Petitioner apprehends his arrest in connection with Amas P.S. Case No. 232 of 2018 registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation as per FIR is that police on confidential information raided the place and found 5-6 persons in suspicious condition and seeing the police party they tried to flee away and one accused was caught at the spot and petitioner is named in the FIR.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case at the instance of police, having no criminal antecedent.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.7338 of 2019(2) dt.07-02-2019 2/2 circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and makes prayer for regular bail, the same shall be considered on the basis of materials available on record, without being prejudiced by this order.
With the above observation, this application is dismissed.
