2. The petitioner seeks bail in a case registered for the offence punishable under Sections-22 (C), 23© and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. According to allegation, 290 piece of tablets and injunctions which are said to be intoxicants, were recovered from beneath the bed of the petitioner.

4. It has been submitted on behalf of the petitioner that the petitioner is a person of clean antecedent and he is under custody since 20-11-2024.

5. A report was called for from the court below regarding the stage of trial of the case.

6. Perusal of the report shows that till date, not a single witness has been examined.

7. On the otherhand, learned counsel for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances as well as clean antecedent and also the period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in connection with Raxaul P.S. Case No. 452 of 2024, N.D.P.S. G.R. Case No. 105 of 2024 subject to condition that the petitioner will appear in the court below on each and every date fixed in the case and if, he fails to do so on two consecutive dates unless he is prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
