1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Parsauni P.S. Case no. 85 of 2023 registered under section 392 of the Indian Penal Code.
3. As per the prosecution case, while the informant was returning on his motorcycle after withdrawing Rs.1,97,000/- it is stated that three accused persons on motorcycle on the point of pistol looted and dispossessed him of the above amount.
4. Learned counsel for the petitioner submits that the FIR was registered against three unknown. The name of the petitioner transpired in course of investigation. He has been falsely implicated on the basis of his alleged confessional
Patna High Court CR. MISC. No.8495 of 2024(2) dt.20-02-2024 2/2 statement made before police. No incriminating article has been recovered from the petitioner's possession. He has not been put on T.I.Parade inspite of his being in custody since 5.9.2023 and has no criminal antecedent.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and having perused the order of the learned trial Court, taking into consideration the allegation in the FIR, no incriminating article having been recovered from the petitioner's possession who is in custody since 5.9.2023 and charge-sheet having been submitted in the case without putting the petitioner on T.I.Parade, the petitioner is directed to be enlarged on bail in connection with Parsauni P.S. Case no. 85 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sitamarhi.
