2. The petitioners apprehend their arrest in a complaint case punishable for the offence under Sections 120B, 468, 471 read with 34 of the Indian Penal Code.
3. The complainant Karu Mandal has lodged the complaint case against four accused persons including these petitioners alleging therein that he sold his 4.5 decimals of land, bearing khata No.64, plot No.323 to these petitioners through a
Patna High Court CR. MISC. No.8134 of 2026(6) dt.09-07-2026 2/3 registered sale-deed, but later on, it was transpired that the petitioners have fraudulently got registered the sale deed against his nine decimals of land by making a forgery with the complainant at the time of execution of sale deed.
4. Learned counsel for the petitioners submits that petitioners are quite innocent and have committed no offence. The dispute involved in the complaint petition is of civil nature and none of the acts allegedly committed by the petitioner give rise to any criminal liability. He further submits that agreement was also made between the parties for sale of 9 decimal of land for a considering amount of Rs. 4 Lakhs, out of which, Rs. 2 Lakhs was given as an advance and thereafter, on 20.06.2023, after receiving entire consideration money, the complainant registered sale-deed in favour of petitioners, vide Deed No. 7127, but only with a view to grab more money, the complainant has lodged this false and concocted case. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the opposite party no. 2 opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner
Patna High Court CR. MISC. No.8134 of 2026(6) dt.09-07-2026 3/3 be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Jamui in connection with Complaint Case No. 894(C) of 2023, subject to condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S.
