JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Bihta P.S. Case No. 40 of 2019, registered for offences punishable under Section 448, 341, 387, 506 and 504/34 of the Indian Penal Code pending before the Additional Chief Judicial Magistrate-I, Danapur, Patna.
As per prosecution case, there is allegation of demand of ransom of Rs. 5,00,000/- against the petitioner who is named in the First Information Report. Apart from that, it appears that he is accused in ten other cases.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and there is no specific material against him and also he is in judicial custody since 20.04.2019.
Heard learned A.P.P. as well as the Informant who has opposed the prayer for bail.
Patna High Court CR. MISC. No.7068 of 2020(3) dt.27-02-2020 2/2 Considering the antecedent of the petitioner, I am not inclined to grant bail to the petitioner. The prayer for bail is rejected.
However, since the petitioner is in custody since 20.04.2019 the Court below is directed to expedite the commitment as well as expedite the trial to conclude as expeditiously as possible.
Accordingly, the application is dismissed.
