1. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Shahkund Police Station Case No. 153 of 2025, disclosing offences under Sections 103(1), 3(5) of the BNS,
3. The prosecution case, in brief, is that the informant had married her daughter, Mangali Devi, to the accused Adesh Singh about two years before. The deceased had a child and was also pregnant at the time of the incident. It is alleged that her husband, along with other family members, subjected her to continuous harassment, abuse, and threats in
Patna High Court CR. MISC. No.8330 of 2026(3) dt.06-05-2026 2/3 connection with repayment of a loan of approximately Rs. 50,000/- which had been facilitated by the husband. Despite repeated pleas by the informant expressing financial inability, the accused persons allegedly persisted in their demands and illtreated the deceased, including depriving her of basic necessities. It is further alleged that on 09.09.2025 at about 3:00 PM, on the instructions of the accused persons, namely Adesh Singh, Ganori Singh, and Ruby Devi, the deceased was killed and her death was made to appear as a hanging.

Learned Counsel for the petitioner submits that they are innocent and have falsely been implicated in the present case solely on account of their relationship with the deceased's matrimonial family. Petitioner No. 1 is the sister-in-law (Gotani) and Petitioner No. 2 is the brother-in-law (Bhaisur) of the deceased. It is submitted that both petitioners were residing separately from the deceased and her husband prior to the alleged occurrence and had no concern with their matrimonial affairs. It is further submitted that the husband of the deceased is already in judicial custody since 23.09.2025.
5. Considering the generality of allegations against the petitioners who are sister-in-law and brother-in-law of the deceased, I am inclined to grant the petitioners privilege of
Patna High Court CR. MISC. No.8330 of 2026(3) dt.06-05-2026 3/3 anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IInd, Bhagalpur, in connection with Shahkund Police Station Case No. 153 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
