ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioner No.1 and 2 are in custody since 24.5.2014 and 13.5.2014, respectively, in connection with Paraiya P.S. Case No.101 of 2013 registered for the offence under Sections 147, 148, 149, 302 and 506 of the Indian Penal Code.

It is submitted on behalf of the petitioners that a fabricated and concocted story was carved out stating that the father of the informant had sent a ghost to the house of the petitioners and to verify this fact, the petitioners and one Sanjay Manjhi had called the informant and his father to the house of Ojha and thereafter it was found that these persons had killed the deceased. Learned counsel for the petitioners submits that the case

Patna High Court Cr.Misc. No.40052 of 2014 (3) dt.03-03-2015 2/2 is wholly concocted and a figment of imagination of the informant. It is further submitted that no overt act has been alleged against these petitioners and they have clean antecedents. Considering the aforementioned submissions and also the fact that co-accused Sanjay Manjhi and Balgovind Manjhi have been extended the privilege of bail in Cr.Misc. No.35050 of 2014, vide order dated 20.1.2015, let the above named petitioners be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Pratibha, learned Judicial Magistrate, 1st Class, Gaya, in connection with Paraiya P.S. Case No.101 of 2013.
