In this case, the petitioner is seeking anticipatory bail in connection with Palasi P.S. Case No.250 of 2019 registered for offence punishable under sections 272 and 273 of the Indian Penal Code and 30 (a) of the Bihar Prohibition and Excise Act. A motor cycle was intercepted from there 48 litres of liquor has been recovered, but the driver of the motor cycle fled away. The name of the petitioner has transpired during investigation by one Pintu Kumar Choudhary making allegation that he fled away from there.
Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the
Patna High Court CR. MISC. No.5236 of 2020(2) dt.29-02-2020 2/2 petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law, preferably on the same day.
