JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 03.03.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner is in jail custody since 1.4.2014 in a case registered under section 302/34 of the IPC and section 3/4 of the Prevention of witch Practices Act, 1999. There are eight persons named in the first information report and omnibus allegation of assault has been levelled against all accused persons including the petitioner.

Learned counsel for the petitioner submits that no specific overt-act has been attributed against the petitioner and moreover, it is stated that deceased was beaten by fists and slaps.

Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.39393 of 2014 (4) dt.03-03-2015 as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Sherghatti District Gaya in Imamganj P.S. Case no. 35/2011.
