JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Excise Case No. 78 of 2020 (Computer Registration No. 77 of 2020) registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act. The petitioner had earlier approached this Court for grant of regular bail which was rejected by an order dated 13.05.2020 passed in Cr. Misc. No. 18315 of 2020 with an observation that he shall be at liberty to renew his prayer for bail after six months. Accordingly, this application has been filed renewing the prayer for grant of regular bail. The petitioner is in

Patna High Court CR. MISC. No.17779 of 2021(2) dt.10-03-2021 2/2 custody since 29.02.2020. It has been submitted in paragraph 3 of the application that the petitioner has no criminal antecedent. Allegedly, from a cattle-shed adjacent to the petitioner's house 219.06 liters of illicit liquor was recovered. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has remained in custody for more than a year and there is no chance of conclusion of trail in near future.

Considering the submissions advanced on behalf of the petitioner and the observation made in the last order while rejecting the prayer for bail, this application is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 2-cum-Special Judge, Excise Act, Samastipur in Excise Case No. 78 of 2020 (Computer Registration No. 77 of 2020).
