The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.

As per the prosecution case, the motorcycle of the informant along with the mobile phone were stolen. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The petitioner has been falsely implicated in course of investigation where it was alleged that he along with Md. Abulaish Sheikh were caught selling the stolen motorcycle. The allegations are false and concocted. The said Md. Abulaish has been enlarged on bail

Patna High Court CR. MISC. No.17519 of 2021(2) dt.04-09-2021 2/2 vide order dated 2.3.2021 passed in Cr. Misc. no. 40353 of 2020. The petitioner is in custody since 28.8.2020 and investigation in the case has concluded Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to co-accused and the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Punaura P.S. Case no. 87 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
