2. The petitioner apprehends his arrest for the offences alleged under Sections 326, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act registered in connection with Begusarai Town P.S. Case No. 681 of 2018.
3. It is submitted that the petitioner has been falsely implicated and the accusation of firing on the informant is upon co-accused Kanhaiya Singh @ Khonma who is said to have been riding as a pillion on the motorcycle being driven by the petitioner. It is therefore submitted that the accusation under the Arms Act is not made out against the petitioner. It is further submitted that in any event the injury on the knee of the
Patna High Court Cr.Misc. No.7105 of 2019(2) dt.07-02-2019 2/2 informant which is on non-vital part of the body.
4. Having regard to the nature of accusation, gravity of the offence alleged as well as the allegation showing participation of the petitioner in the occurrence as well as his criminal antecedents which discloses the petitioner is accused in one prior case under Section 302, 201/34 of the Indian Penal Code, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The anticipatory bail petition stands dismissed.
