Case No. 252 of 2019, registered for the offences punishable under Sections 149, 341 and 302 of the Indian Penal Code. Petitioners and other accused persons are named in the FIR and there is general allegation of assault to the deceased while fleeing away after committing robbery.
Submission of learned counsel for the petitioners is that the deceased was assaulted by the villagers while fleeing after committing robbery and no specific allegation has been attributed against them and considering the same co-accused persons have been granted bail by co-ordinate Bench of this
Patna High Court CR. MISC. No.5438 of 2020(2) dt.31-01-2020 2/2 Court by order dated 16.1.2020 passed in Cr.Misc. No. 2258 of 2020 and they are in custody for three months. Heard learned APP also.
In view of above facts and circumstances, let petitioners be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-IV, Barh, Patna, in connection with Mokama P.S.
