2. The petitioner apprehends his arrest in connection with Sikandra P.S. Case No. 49 of 2022, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and 25(1-B)a, 26, 35 of the Arms Act.
3. As per allegation, the informant received a secret information that 10-12 unknown persons were assembled in the premises of a college with an intention to commit some crime. The police reached there and saw some persons were sitting there and talking. On seeing police, they started fleeing from there, but the police apprehended four persons and rest of them became successful in fleeing. From apprehended persons arms and ammunition were recovered and they disclosed that they were planning to loot the

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing incriminating was recovered from possession of the petitioner. Coaccused persons who were arrested at the spot and from whose possession arms and ammunition were recovered have named this petitioner in their confessional statements except that there is nothing against the petitioner in the entire case diary.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Sikandra P.S. Case No. 49 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) SONALI/- U T
