The petitioner is in custody in connection with Jaynagar P.S. Case No. 08 of 2020 for the offenses under Sections 272, 273, 414, 34 of the Indian Penal Code and 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 138 ltrs of wine was recovered from the possession of the petitioner. The petitioner is in custody since 08.01.2020. Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two

Patna High Court CR. MISC. No.5958 of 2020(2) dt.03-02-2020 2/2 sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge (Excise), Madhubani, in connection with Jaynagar P.S. Case No. 08 of 2020. However, it is made clear that in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail bonds of the petitioner in the present case.
