This application for anticipatory bail arises out of Forest Case No. 10 of 2018 for the offence under Sections 2, 27, 31, 32, 39, 44, 49(b), 50 and 51 of the Wild Life Protection Act. I find force in the submission made on behalf of the petitioner that there is no distinction between his case and the case of co-accused Surendra Duwariya, who has been allowed anticipatory bail by order dated 29.08.2018 passed in Cr. Misc. No. 49435 of 2018, copy of which has been brought on record by way of Annexure-2 to this application.

Considering the above, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten

Patna High Court Cr.Misc. No.6830 of 2019(2) dt.06-02-2019 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in Forest Case No. 10 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
