Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 272 and 273/34 of the Indian Penal Code, Section 20/22 of the NDPS Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, registered in connection with Saraiya P.S.Case No. 443 of 2021.

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot, nor any

There is nothing against the petitioner in the present case, except the criminal antecedents disclosed in paragraph no.3 of the bail petition. He has also submitted that the petitioner is in custody since 06.08.2021.

Considering the above facts and circumstances, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, West Muzaffarpur in connection with Saraiya P.S.Case No. 443 of 2021. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
