JUSTICE DINESH KUMAR SINGH ORAL JUDGMENT Date : 13-04-2018 Heard Mr. Kaushal Kishore Jha, learned counsel for the petitioner and Mr. Rakesh Kumar Srivastava, learned counsel for the respondent-State.

Though, the present writ has been registered on 06.04.2018, but in view of the nature of order this Court intends to pass, this Court is neither inclined to adjourn the matter any further nor inclined to issue notice to private respondent nos. 5 and 6. The present writ application has been filed for a direction to the respondent authorities for removal of encroachment over a government land, appertaining to Thana No. 238, Khata No.2, Plot Nos. 4, 1/35 and 1/36, situated in Mauza

Patna High Court CWJC No.6567 of 2018 dt.13-04-2018 2/3 Maharajganj, P.S. K. Hat, District Purnea, which has been settled in favour of the petitioner by virtue of Purcha issued in Ceiling Case No. 01 of 2017-18.

Learned counsel for the petitioner confines his prayer to the extent of disposal of representation submitted by him before respondent no.2, the District Magistrate, Purnea on 27.03.2018, as contained in Annexure-4.

It is further submitted that the petitioner belongs to a Scheduled Tribe Community, while private respondent no.4 and 5 have deprived him of the land in question, concerning which purcha has been issued in his favour.

Learned AC to GP-15 submits that if the representation of the petitioner has not been disposed of till date, it will be disposed of by respondent no.2, the District Magistrate, Purnea within a time frame.

Considering the confined prayer of learned counsel for the petitioner, it is expected from respondent no.2, the District Magistrate, Purnea to dispose of the representation of the petitioner filed on 27.03.2018, as contained in Annexure-4, within a period of six weeks from the date of receipt/production of a copy of this order.
