JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This is an application for grant of anticipatory bail in connection with Bahadurpur P.S. Case No. 183 of 2018, disclosing offences under Sections 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation as per F.I.R. against the petitioner is of causing death of the deceased and specific allegation against coaccused Golu Kumar that he has fired upon the deceased and the petitioner is not named in the F.I.R., later on his name transpired on the basis of confessional statement of co-accused. Submission of learned counsel for the petitioner is that except confessional statement of co-accused, there is absolutely nothing against the petitioner and similarly situated one of the co-accused has been granted anticipatory bail by this

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Patna City, in connection with Bahadurpur P.S.
