JUSTICE SANDEEP KUMAR ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Sour Bazar P.S. Case No. 457 of 2022 registered for the offence under Sections 30(a), 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.09.2022 and there is recovery of 177 litres 480 ml from his possession and he has two criminal antecedents.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of

Patna High Court CR. MISC. No.7337 of 2023(2) dt.03-05-2023 2/2 liquor from his possession, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Spl. Judge (Excise), Saharsa in connection with Sour Bazar P.S. Case No. 457 of 2022.

The District Judge/ Special Judge (Excise) is directed to expedite the trial of following cases:- (i) Spl. Excise case No.69/2022 for the offence under section 30(a) of Excise Act pending in the court of Spl. Judge, Saharsa.

(ii) Sour-Bazar P.S. case no.514/2017 for the offence under section 30(a) of Excise Act.
