The petitioner Babloo Yadav seeks bail in Wazirganj P.S. Case no. 65/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The informant alleged that some dispute arose on the eve of Holi. The informant named 10 persons including the petitioner Babloo Yadav and alleged that they all assaulted his uncle Jagdish Yadav. Dilip Mistry and Kapinda Mistry are alleged to have pierced pointed rod on the head and thigh of the deceased Jagdish Yadav. Consequently, Jagdish Yadav died. Sanjay Yadav is also alleged to have been assaulted by the petitioner and others. No specific allegation of assault is made against the petitioner Babloo Yadav. Similarly situated co-accused Sibodh Kumar, Umesh Yadav, Mithilesh Yadav, Chunchun Yadav and Sanoj Yadav have

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, in connection with Wazirganj P.S.
