The petitioner is the husband and he has been charged for being tried for an offence under Section 304B etc IPC. The information was lodged by the mother of the deceased Rudali Devi who was married to the petitioner and was living undisputedly in his house. The report itself indicated that the mother of the deceased was informed that her daughter had fallen in the well and had died of drowning but the informant alleged that she learnt that the present petitioner had killed her daughter and had consigned the dead body in the well.

It is very much noted down in the rejection order itself that some paragraphs of the case diary, which included the statement of the brother of the lady also, indicated as if the lady had accidentally fallen into the well while she was returning home

Patna High Court Cr.Misc. No.40365 of 2014 (2) dt.14-01-2015 after attending to call of nature and the petitioner in order to save her also jumped into it. Both were salvaged from the well. A few witnesses during trial also appear not supporting the charges and stated on facts regarding the defence of the petitioner. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Amrit Lal Yadav, Adhoc Additional District & Sessions Judge-VIII, Munger in Dharahara P.S.Case No.13 of 2014/ SC.No.512 of 2014.
