2. The petitioner seeks regular bail in connection with Civil Lines P.S. Case No. 439 of 2024 registered for the offence under Sections 69, 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 3⁄4 of the DP Act and Section 4 of the POCSO Act.

3. Though the allegation against the petitioner is of kidnapping the victim girl but from the statement of the victim girl recorded under Section 183 BNSS, it appears that the petitioner and the victim were in a relationship and the victim had eloped with the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 23.08.2024.

5. Learned counsel for the informant has vehemently opposed the prayer for bail.

6. Considering the statement of the victim girl, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-VI, Gaya/concerned Court below in connection with Civil Lines P.S. Case No. 439 of 2024.
