JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner being husband of the informant is cooling his heels behind the bar since 02-05-2015 in a case registered under Sections-498A, 323, 504, 494/34 of the Indian Penal Code, particularly, in the circumstances, when his marriage was solemnized 10 years ago.

It would appear from perusal of the impugned order that petitioner was granted provisional anticipatory bail by this court in Cr. Misc. No. 49314 of 2013 with condition that the petitioner shall make payment of Rs. 750/- per month to the

Patna High Court Cr.Misc. No.40606 of 2015 (2) dt.10-09-2015 2/2 informant, failing which, the provisional bail granted to the petitioner shall, automatically, be cancelled and furthermore, it would appear that petitioner failed to comply with the order of this court, resulting cancellation of his provisional bail. Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahila P.S. Case No. 05 of 2013 to the satisfaction of Shri Prashant Kumar, Judicial Magistrate-Ist Class, Purnea.
