The petitioner seeks bail in a case under Section 396 and other sections of the Indian Penal Code, 27 of Arms Act, section 3⁄4 of Explosive Substance Act, and section 17 of C.L.A. Act.

The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The name of the petitioner figured in the case in the confessional statement of co-accused Bipat Chaudhary. The petitioner is in jail since 23.04.2015 but he has not been put on T. I. Parade and similarly situated accused have already been enlarged on bail. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.39845 of 2015 (2) dt.31-08-2015 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana, East Champaran at Motihari in Madhuban P.S. Case No. 88 of 2005.
