Mr. Ramji Kumar, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-02-2026 Heard learned counsel for the petitioners, complainant and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Complaint Case No. 127 of 2018 , punishable for the offences under Sections 323 and 354 of the Indian Penal Code.

3. As per prosecution case, in the background of land dispute, the petitioners and other co-accused persons assaulted complainant and her family members, when the complainant opposed their act of filling water for hatching fish in a ditch over the land of the complainant.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence.

He further submits that the case is at the stage of admission before charge and till date, only one witness has been adduced by the complainant. Petitioners are in custody since 11.11.2025.

5. However, learned A.P.P. for the State as well as learned counsel for the complainant vehemently opposed the bail application.

6. Considering the nature of accusation and period of custody, the bail application is allowed. The petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate XIII, Vaishali / concerned Court in connection with Complaint Case No. 127 of 2018.
