The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, on the alleged date and time of occurrence, all the accused persons including petitioners armed with lathi, rod, bricks and stone assaulted the informant and his family members, as a result of which three persons from the informant side sustained injuries.

It is submitted that there is dispute for setting up shop between the informant and co-accused Sidhnath Sao and both

Patna High Court CR. MISC. No.7707 of 2023(2) dt.11-05-2023 2/2 are neighbours. Allegation of assault is general and omnibus and no specific overt act has been alleged against the petitioners. Similarly situated co-accused have been granted anticipatory bail by a Coordinate Bench of this court vide order dated 17.04.2023 passed in Cr. Misc. No. 8232 of 2023 and order dated 25.04.2023 passed in Cr. Misc. No. 11400 of 2023. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Danapur, Patna in connection with Maner P.S. Case No. 584 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
