The petitioner apprehends his arrest in Turkauliya P.S. case No. 555 of 2017 registered under Section 379 of the Indian Penal Code.
The informant, a contractor, lodged the case in pursuance of the direction as contained in letter No. 154 dated 31.08.2017 issued by Circle Officer, Banjariya. The informant alleged that petitioner cut three Arjun trees standing by the side of road.
The learned counsel for the petitioner submits that there is no eye witness of the occurrence. Nobody has seen the petitioner cutting the trees standing by the side of road and on mere suspicion the name of petitioner figured in the case. No
Patna High Court Cr.Misc. No.7166 of 2019(2) dt.07-02-2019 2/2 theft article or log of any wood was recovered from the house of conscious possession of the petitioner.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkauliya P.S. case No. 555 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
