The petitioner seeks bail in connection with Mohania P.S. Case No. 248 of 2019 for the offence under Sections 304-B/34 of the Indian Penal Code.
Earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 28.02.2020 passed in Cr. Misc. No. 12229 of 2020.
Learned counsel for the petitioner has submitted that the petitioner is languishing in judicial custody since 10.07.2019 i.e. more than two years and there is no substantial progress in the trial.
A report was called for and the same has been
Patna High Court CR. MISC. No.17438 of 2021(4) dt.15-09-2021 2/2 received. From perusal of the same, it appears that out of seven prosecution witnesses, one witness has been examined and the case is running for prosecution evidence. Learned A.P.P. for the State does not refute the factual position of the trial.
Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned A.D.J.-XI, Kaimur at Bhabua in connection with S.T. No. 248 of 2019 arising out of Mohania P.S. Case No. 248 of 2019/ S.T. No. 223 of 2019.
