2. The petitioner apprehends his arrest in connection with Siwan Excise P.S. Case No. 323 of 2024 registered for the offence punishable under Sections 30(a), 32(2) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. There is recovery of 600.840 liters of illegal foreign wine has been recovered from the truck in question.

4. Learned counsel for the petitioner submits that the petitioner is ready to donate Rs. 50,000/- (Rupees Fifty Thousand Only) in some charitable organization without accepting his guilt. He further submits that the petitioner is the owner of the truck in question. It is the driver and the Khalasi

5. Considering the facts and circumstances of the case as well as the submission made on behalf of the petitioner, this application is allowed.

6. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. II, Siwan in connection with Siwan Excise P.S. Case No. 323 of 2024, subject to the conditions as laid down under Section 482 of the B.N.S.S., 2023 and also subject to condition that:- (I). The petitioner shall deposit an amount of Rs. 50,000/- (Rupees Fifty Thousand Only) in Ramakrishna Mission Ashrama, Chapra and produce the receipt of the same before the Court below. The bail bonds of the petitioner shall be accepted only after verifying the genuineness of the receipt produced by the petitioner. (Sandeep Kumar, J) Shishir/- U T
