The petitioner is in custody in connection with G.O. Case No. 46 of 2020 arising out of P.R. Case No. 42 of 2019 for the offenses under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case total 198.63 ltrs of liquor was seized. Learned counsel for the petitioner further submits that nothing was recovered from the conscious possession of the petitioner. The petitioner is in custody since 09.01.2020.
Considering the fact that the petitioner has got a clean
Patna High Court CR. MISC. No.5339 of 2020(2) dt.31-01-2020 2/2 antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge (Excise Act), Darbhanga, in connection with G.O. Case No. 46 of 2020 arising out of P.R. Case No. 42 of 2019. However, in the event the petitioner is found involved in similar cases in future, the court below shall be at liberty to cancel the bail of the petitioner. (Anil Kumar Upadhyay, J) uma/- U T
