JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Baheri P.S. Case No. 256 of 2019 registered for the offence punishable under Sections 392, 411 of the Indian Penal Code. When the informant was coming with motorcycle some accused persons intercepted to him and snatched the key and the motorcycle and also the cash.

It appears from the FIR that later on two persons including the petitioner was apprehended and one purse was recovered from him.

Submission of learned counsel for the petitioner is that at seizure list recovery at 07:15 and the FIR at 07:45 and as such, it is a case of false implication of the petitioner and he is in custody since 08.11.2019 and other co-accused persons have already been granted bail by the learned trial court.

Patna High Court CR. MISC. No.7799 of 2020(2) dt.20-02-2020 2/2 On the other hand, learned A.P.P. has opposed the prayer for bail on the ground that the petitioner was arrested from there and thereafter looted articles was recovered from him also.

Considering the submissions as made above, I am not inclined to grant regular bail to the petitioner at this stage. Accordingly, this application is dismissed.
