The petitioner has preferred this application for grant of regular bail in a case registered under sections 457 and 380 of the Indian Penal Code to which sections 401, 411 and 414 of the Indian Penal Code were added subsequently.
As per the prosecution case, idols of god were stolen from the temple and in course of investigation one of the idols was recovered from the house of this petitioner. It is submitted by learned counsel for the petitioner that the allegations as levelled against the petitioner are false and concocted. He has been falsely implicated in the case. No incriminating article has been recovered from his house or possession. It is submitted that co-accused Bipin Yadav and
Patna High Court CR. MISC. No.17517 of 2021(2) dt.04-09-2021 2/2 Ajay Kumar have been enlarged on bail vide order dated 29.6.2021 passed in Cr. Misc. no. 4228 of 2021 and order dated 16.4.2021 passed in Cr. Misc. no. 5463 of 2021. The petitioner is in custody since 27.5.2020 and has no criminal antecedent. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case including grant of bail to co-accused and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with K Hat (Sahayak) P.S. Case no. 153 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea.
