The petitioner seeks bail in anticipation of his arrest in connection with Rajiv Nagar P.S. Case No. 53 of 2020 dated 07.02.2020 instituted for the offences under Sections 498(A), 323, 354(A) and 34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the petitioner has submitted that he is ever ready to negotiate with his wife for settlement of matrimonial discord.

However, the learned counsel for the opposite

No.17623 of 2021(2) dt.07-01-2022 2/2 party no. 2 has submitted that the wife has suffered at the hands of the petitioner because of the ill-treatment meted out to her and also his physical incapacity to consummate the marriage. Be that as it may, she is ready for a one time settlement, if the terms offered by the petitioner is reasonable.

Considering the aforenoted stand of the parties, it is directed that in case the petitioner surrenders before the court below within a period of six weeks he shall be released on provisional bail subject to the satisfaction of the court below. Simultaneously, the opposite party no. 2 shall be noticed. On appearance of opposite party no. 2, the court below will explore the possibilities of a onetime settlement for which the O.P. No. 2 is ready and on settlement, the provisional bail granted to the petitioner shall be confirmed. The reasonableness of the stand of the parties shall be taken into account while passing a final order of bail.
