The petitioner is languishing in jail since 13.07.2015 in a case instituted under Sections 376 and 511 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offence Act, 2012.

As per prosecution case, it is a case of attempt of rape upon the informant's daughter who is aged about seven years by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal

From perusal of Annexure-2, it would appear that there is admitted property dispute between the parties and from the medical examination report of the doctor, it would appear that the same do not support the prosecution case. The said medical examination report of the victim is in para-34 of the case diary.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Patna in connection with Special Case No.96 of 2015 arising out of Hawai Adda P.S.Case No.108 of 2015.
