JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-07-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 04.03.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Special Case No. 151 of 2019, arising out of Special (NDPS) case arising out of F.No. NCB/PZU/V-21 of 2019, for the offence under Sections 8(c)/20(b)(ii)(c)/29 of the N.D.P.S. Act, pending in the Court of learned Sessions Judge / Special Judge, Patna.
Learned counsel appearing on behalf of petitioner
Patna High Court CR. MISC. No.17810 of 2021(2) dt.28-07-2021 2/2 submits that while the prayer for bail of the petitioner was earlier refused on 16.06.2020 passed in Criminal Miscellaneous No. 13978 of 2020 taking into consideration that 50 Kg of Ganja has been recovered from the vehicle in which the petitioner was found sitting. The petitioner is in custody since 25.10.2019.
Admittedly, the prayer for bail of the petitioner was refused on 16.06.2020 passed in Criminal Miscellaneous No. 13978 of 2020, on merit, I find no fresh ground to reconsider the prayer for bail of the petitioner. Accordingly, the prayer for bail of the petitioner is again rejected. (Rajendra Kumar Mishra, J) manish/- U T
