The petitioner filed this petition for quashing of the order of suspension as contained in Memo No. 389 dated 2nd of April, 2016 (Annexure-3).

Learned counsel for the petitioner submits that the order of suspension is based on non-est ground. It is further submitted that the departmental proceeding was initiated and the enquiry officer has already submitted the enquiry report.

Considering the fact that since the departmental proceeding has already been concluded, I am not inclined to interfere

Accordingly, the writ petition is disposed of with a direction to the disciplinary authority to pass order on the enquiry report within two months from the date of receipt/production of a copy of this order and thus the writ petition is disposed of.
