JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being RPF Inspector is languishing in custody since 26.8.2014 in a case registered for the offences punishable under Section 13(2) read with 13(1)(e) of the P.C. Act. The petitioner's assets have been found disproportionate to his own source of income to the tune of Rs.67,64,119 for the check period 1.4.2002 to 1.3.2013.
It is submitted by the learned counsel for the petitioner that the investigation has already been concluded, cognizance has been taken and the petitioner will appear regularly during trial. It is submitted by Mr. Bipin Kumar Sinha, learned counsel for the CBI that the petitioner did not cooperate at the initial level of investigation hence, the privilege of bail should be
Patna High Court Cr.Misc. No.40609 of 2014 (5) dt.23-01-2015 2/2 given after the charges are framed and some private witnesses are examined.
Considering the fact that it is disproportionate asset case in which investigation has already been concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge CBI-III, Patna in connection with Special Case No. 7 of 2013 arising out of CBI R.C. 8(A) of 2013.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
