Learned Counsel for the petitioner submits that this application may be disposed of with a direction to consider the petitioner's representation, made to the Civil Surgeon -cum- Chief Medical Officer, Nalanda, dated 26.12.2012, wherein it has been indicated that the death - cum- post retiral dues, payable to the family of the petitioner consequent upon the death of his father, has not been cleared because service book of the deceased

Patna High Court CWJC No.10083 of 2016 (2) dt.20-07-2016 2/2 employee is missing.

Learned Counsel for the State has no objection if this application is disposed of with the direction, as sought for by learned Counsel for the petitioner. Considering the above, the Civil Surgeon -cumChief Medical Officer, Nalanda, is directed to consider the petitioner's representation, dated 26.12.2012 (Annexure-4) and take appropriate steps in accordance with law. The Court expects that the legal entitlement of the petitioner shall be considered and paid within a period of six months from the date of receipt/production of a copy of this order.
