Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Dawath P.S. Case No. 125 of 2022 lodged under Sections 25(1b)a/ 26/ 35 of the Arms Act. As per the prosecution case, the recovery of arms has been made from the possession of the petitioner. Learned counsel for the petitioner submits that antecedent of the petitioner is clean and he is in custody since 12.06.2022 and completed ten months. Counsel submits that charge-sheet has already been filed in this case. He further submits that the other co-accused persons have been granted
Patna High Court CR. MISC. No.8536 of 2023(2) dt.03-05-2023 2/2 bail by the Co-ordinate Bench of this Court vide order dated 12.04.2023 and 24.04.2023 passed in Cr. Misc. No. 8170 of 2023 and Cr. Misc. No.12680 of 2023 respectively. Learned counsel for the State opposes the prayer for bail and submits that ten months have already been crossed. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Rohtas at Sasaram in connection with Dawath P.S. Case No. 125 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
