The petitioner has preferred this application for grant of regular bail in a case registered under sections, 272 and 273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the FIR, 48 bottles of 180 ml. each and 72 bottles of 375 ml. each along with two motorcycles were recovered from the possession of one Chanchal Kumar Pandey.

It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR. His name transpired in the confessional statement of accused Chanchal Kumar Pandey made before the police. No incriminating article has

Patna High Court CR. MISC. No.17533 of 2021(2) dt.27-08-2021 2/2 been recovered from his possession. He is in custody since 9.1.2021 and has no criminal antecedent.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Patori P.S. Case no. 277 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge II - cum - Special Judge, Excise, Samastipur.
