JUSTICE SHIVAJI PANDEY ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is apprehending his arrest in connection with R.C. Case No. 14(S)2008 registered for offences under sections 420, 468, 471 of the Indian Penal Code. A complaint has been filed by the Informant against the petitioner to have obtained the service on the basis of forged and fabricated Intermediate certificate led to lodging of the criminal case by the C.B.I. and the C.B.I. submitted the closure report. The Informant has also not objected the filing of the closure report and the court below has taken cognizance. Earlier the petitioner had moved before this Court in Cr. Misc. No.16195 of 2009 which was disposed of vide order

Patna High Court Cr.Misc. No.40812 of 2017 (2) dt.04-10-2017 dated 1.9.2009 wherein there was a findings that as the closure report has been submitted by the C.B.I., the petitioner has no apprehension of arrest.

In view of the above, let the petitioner, namely, Vibhanshu Shekhar, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, C.B.I. cum Additional Chief Judicial Magistrate, Patna in connection with R.C. Case No. 14(S)2008, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
