The petitioner seeks regular bail in connection with Warisnagar PS case no. 96 of 2017 registered for the offence punishable under Sections 461, 379 of Indian Penal Code.

The allegation is regarding the petitioner having committed theft in the shop of the informant. The learned counsel for the petitioner submits that neither any recovery has been made from the petitioner nor any test identification parade has been held in order to connect the petitioner with the alleged crime. It is further submitted that the petitioner has been subsequently remanded in two other cases, however prior to filing of the present case, the petitioner

Patna High Court Cr.Misc. No.9700 of 2019(2) dt.19-02-2019 2/2 was having clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 12.05.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar PS case no. 96 of 2017.
