JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner, learned Additional P.P. as well as learned counsel for the informant. The petitioner seeks bail in Pipariya P.S. Case no. 17/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named Chitranjan Yadav, Annu Yadav and Anurag Yadav and four unknown persons and alleged that when his brothers Sanjay Yadav and Dayanand Yadav came with wheat loaded tractor the accused persons assaulted his brothers on the order of Chitranjan Yadav. Annu Yadav assaulted his brother Sanjay Yadav. Anurag Yadav and Annu Yadav also assaulted Dayanand Yadav and Siris Yadav with the butt of the pistol. Sanjay Yadav died during course of treatment. Sanjay Yadav got one injury on his head which is said to have caused by hard blunt

Patna High Court Cr.Misc. No.40766 of 2015 (2) dt.03-09-2015 2/2 substance. There is no allegation of assault against the petitioner. The petitioner is in jail since 12.05.2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Raghubansh Narayan, Judicial Magistrate 1st Class, Lakhisarai, in connection with Pipariya P.S. Case no. 17/2015.
