====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 23-06-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in a case registered for the offence punishable under Sections 302/120(B)/34 of the Indian Penal Code.

The main allegation is that the accused persons including the petitioner killed the informant's son by strangulation and the body of the deceased was hanged from a tree.

The main submissions advanced by learned counsel for the petitioner are that as per prosecution story the informant had seen the accused persons pressing the neck of deceased but he did not take any attempt to save the deceased rather he

No.7716 of 2022(2) dt.23-06-2022 2/2 rushed to his village hence the said conduct clearly shows fabrication of a false story and in the present case one similar situated co-accused Kailash Ram has been granted bail by this court vide Cr. Misc. No. 35377 of 2021 and the petitioner has been languishing in jail since 26.07.2021. Further submission is that there is criminal antecedent of one case against the petitioner in which he is on bail, in fact the deceased committed suicide by hanging and in the, FIR any motive of the petitioner to commit the alleged murder has not been mentioned. Learned APP has opposed the prayer for bail.

Considering the above submissions and petitioner's case being similar to the co-accused Kailash Ram, who has been granted regular bail by this Court vide order passed in above mentioned Cr. Misc. hence the petitioner also deserves to the same privilege accordingly, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Darauda P.S. case No. 64 of 2020.
