JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-01-2015 Both the above4 stated petitions arise out of K.Nagar P.S.Case No. 498 of 2013 a case registered under Section 147,148,149,188,353,447,384 and 120B of the Indian Penal Code and accordingly both the above stated petitions are being disposed of by this common order.
Heard learned counsel for the petitioners as well as
Patna High Court Cr.Misc. No.26445 of 2014 (4) dt.09-01-2015 2/2 learned Additional Public Prosecutor for the State. Petitioners in Cr. Misc. No. 26445 of 2014 are not named whereas Cr. Misc. No. 41464 of 2014 is named in the first information report and the accusation against the petitioners is that they along with more than 150 persons forcibly took possession of Rayati land and when policy party came there, to dispossess the petitioners and their associates, they became furious and made attack on the police party.
It appears from the first information report as well as impugned order that none has sustained any injury. Petitioners are in jail custody since long.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnia in connection with K.Nagar.P.S.Case No. 498 of 2013 arising out of G.R.No. 3685 of 2013.
