Yesterday also, learned counsel had not remain present. It appears form the record that the present acquittal appeal has been filed in the year 2020 against the judgment and order of acquittal passed by the Trial Court. The present appeal was listed under the caption "For Orders on Office Notes" on 28.04.2023. On 28.04.2023, this Court granted four weeks' time to the appellant for removal of the defects. Thereafter, learned counsel for the appellant did not remove the defects and, therefore, after the period of one and a half year, i.e., on 24.09.2024, matter was once again listed under the same heading.

2. On 24.09.2024 also, no one appeared on behalf of the appellant. Therefore, in the interest of justice, the matter was adjourned for 26.09.2024. On which date also, as observed hereinabove, nobody remained present.

3. Looking to the aforesaid facts and circumstances, we have no option but to dismiss the appeal for non-removal of the defects.
