28-06-2021 Heard learned counsel for the parties through video conferencing.
The petitioner seeks bail in Bhagwanpur P.S. Case No. 23 of 2020, registered for the offence under Section 304(B)/34 of the Indian Penal Code.
As per the prosecution case, the daughter of the informant was married with petitioner on 30.01.2015 and it is alleged that after the marriage, this petitioner alongwith other accused persons started demanding dowry and due to nonfulfillment of the same, on 04.02.2020, all accused persons killed the daughter of the informant.
It is submitted on behalf of petitioner that petitioner is innocent and there is general & omnibus allegation. Petitioner has not demanded any dowry. In fact, there was some family feud, for which, the deceased committed suicide. Petitioner
Patna High Court CR. MISC. No.12200 of 2021(2) dt.28-06-2021 2/2 claims clean antecedent and he is in custody since 02.03.2020. However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of the deceased and there is specific allegation against him. The deceased died in her matrimonial home within seven years of her marriage. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
