JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 24-07-2017 Pending finalization of confiscation proceedings No. 9(M)/2017 which is under consideration before the District Magistrate, Nawada, this application has been filed for release of vehicle of the petitioner, namely, a motorcycle (Apache) bearing registration No. BR 21K-3529.

It is an admitted position that during the pendency of the matter, this Court has directed for release of the vehicles and identical petitions have been disposed of directing for release of vehicle pending finalization of the confiscation case. Keeping in view the aforesaid, this petition is also allowed. It is directed that pending finalization of the confiscation in

Patna High Court CWJC No.10058 of 2017 dt.24-07-2017 2/2 question, the vehicle in question shall be released to the petitioner on his furnishing two surety bonds to the satisfaction of the District Magistrate, Nawada and further undertaking not to alienate the vehicle prejudice to the interest of the State during the pendency of the proceedings and further undertake to keep present the vehicle and produce the same before the District Magistrate, Nawada as and when required. If the aforesaid is done, the vehicle shall be released. With the aforesaid, the petition stands disposed of.
