JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-03-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Sarairanjan P.S. Case No. 91 of 2020, registered for the offences punishable under Sections 382, 34 of the Indian Penal Code. As per allegation, when the informant was coming with his Bolero pick up van bearing registration No. BR31GB2217, it was intercepted by an Alto Car. The miscreants fled away with Bolero pick up van of the informant.
Learned counsel for the petitioner has submitted that there is nothing against the petitioner in the entire case diary except the confessional statement of co-accused Pintu Mandal.

No.18071 of 2021(3) dt.07-03-2022 2/2 On the other hand, learned APP has submitted that not only the name of the present petitioner has been figured in the confessional statement of co-accused Pintu Mandal but the stolen Bolero pick up van was also recovered from the possession of co-accused who inculpated the present petitioner in the alleged occurrence. In the above-mentioned facts and circumstances, it is not a fit case for anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
